“VEGAS FANTASY SWEEPSTAKES”
OFFICIAL RULES
NO PURCHASE OR TEXT MESSAGING IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR TEXT MESSAGING WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The “VEGAS FANTASY SWEEPTSTAKES” (“Sweepstakes”) starts at 12:01 AM Eastern Time (“ET”) on June 1, 2008. There are two (2) methods of entry as detailed below; via text messaging entry and mail-in entry. This Sweepstakes consists of thirteen (13) specific weekly random drawings (each a “Weekly Random Drawing”) each with its own specific entry period (note #13 entry period includes one additional day) (each a “Weekly Entry Period”) and one (1) Grand Prize random drawing (“Grand Prize Random Drawing”) as detailed below. Entries that are not selected as a winner in a Weekly Random Drawing will NOT remain eligible for subsequent Weekly Random Drawings. All eligible entries received for this Sweepstakes will be eligible for the Grand Prize Random Drawing. The Sweepstakes ends at 11:59 PM Pacific Time (“PT”) on August 31, 2008 for text messaging entry and on September 1, 2008 for the postmarking of a mail-in entry. The Sponsor of this Sweepstakes is MODERN MOBILE MARKETING, 814 S. Westgate, Ste. 105, Los Angeles, CA 90049 (the “Sponsor”). Sweepstakes shall be subject to these Official Rules and by entering, all participants agree to be bound by the terms and conditions herein.
ELIGIBILITY: SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF DATE OF ENTRY.
THIS SWEEPSTAKES IS VOID OUTSIDE THE SPECIFIC AREA STATED ABOVE AND WHERE PROHIBITED BY LAW. PROOF OF ELIGIBILITY MAY BE REQUIRED.
Employees of the Sponsor, Players Network, their respective parent companies, affiliates, subsidiaries, and related companies and agencies (collectively, the “Promotion Parties”), and their immediate families (defined as parents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the household of same, whether or not related, are not eligible to enter or win. This Sweepstakes is void outside the specific area of eligibility stated above and where prohibited or restricted by law. By entering, entrants agree that they have read these Official Rules and to abide by and be bound by all terms of these Official Rules.
HOW TO ENTER THE SWEEPSTAKES: There are two (2) methods of entering this Sweepstakes. The details for each are listed below. As stated above, there are thirteen (13) specific Weekly Entry Periods in this Sweepstakes. The thirteen (13) specific Entry Periods are as follows:

IMPORTANT: AS STATED ABOVE, ENTRIES THAT ARE NOT SELECTED AS A WINNER IN A SPECIFIC WEEKLY RANDOM DRAWING WILL NOT REMAIN ELIGIBLE FOR SUBSEQUENT RANDOM DRAWINGS. ALL ELIGIBLE ENTRIES RECEIVED WILL BE ELIGIBLE FOR THE GRAND PRIZE RANDOM DRAWING.
ONLY FOUR (4) ENTRIES PER PERSON AND/OR CELL PHONE NUMBER WILL BE ACCEPTED PER ANY ONE (1) WEEKLY ENTRY PERIOD. ENTRIES IN EXCESS OF THIS LIMIT WILL BE DISQUALIFIED.
AS STATED ABOVE, THERE ARE TWO (2) METHODS OF ENTERING THIS SWEEPSTAKES. The two (2) methods of Sweepstakes entry are:
HOW TO ENTER THE SWEEPSTAKES VIA TEXT MESSAGING: To enter via text messaging, you may enter by text messaging answers to Las Vegas related trivia questions as follows. Text message VEGAS to 25852 and answer the Las Vegas related trivia question asked in response, via text messaging as prompted. For each trivia question answered during the Weekly Entry Period, you will automatically be entered one (1) time into the Sweepstakes for that specific Weekly Random Drawing (“Text Message Entry”). Each time you answer a trivia question, you will automatically receive another trivia question via text messaging. Note: you do need to answer the question correctly to be entered into the Sweepstakes via the Text Message Entry method. ALL TEXT MESSAGE ENTRIES MUST BE RECEIVED ACCORDING TO THE ENTRY PERIOD SCHEDULE ABOVE TO BE ELIGIBLE FOR SPECIFIC RANDOM DRAWINGS.
IMPORTANT - PLEASE NOTE - A fee of $.99 will be charged for trivia question answered, in addition to any additional standard text messaging fees charged by any service provider(s).
For text messaging, a service contract with a wireless Internet or airtime provider may be required. Wireless Internet use requires a separately purchased service contract. Check with service provider for availability and coverage in area at time of use. Wireless access point required. Availability of public wireless access points may be limited. Cellular telephone service and/or text messaging services may require separately purchased contracts with a cellular telephone service provider or text-messaging provider with coverage in your service area. In addition to the fee specified above for answering the trivia questions, cellular telephone company and/or wireless Internet company determined text-messaging fees may apply for all text messaging to Modern Mobile Marketing and for receipt of text messages from Modern Mobile Marketing. In this Sweepstakes you will be sending and receiving messages and possibly charged in accordance with your text-messaging provider’s contract. Contact your text-messaging provider for complete details on these and any other applicable charges.
HOW TO ENTER THE SWEEPSTAKES FOR FREE BY MAIL WITHOUT TEXT MESSAGING: To enter the Sweepstakes by mail without text messaging, send
a postcard, hand printed with your name, address, city, state, zip code, age daytime telephone number, e-mail address (if applicable) and the Drawing # (from the chart above) for which you are entering to: “LAS VEGAS FANTASY SWEEPSTAKES”, c/o Modern Mobile Marketing, 7610 Beverly Blvd., PO Box 480620, Los Angeles CA 90048-0620 (“Mail-in Entry”). ALL MAIL-IN ENTRIES MUST BE RECEIVED ACCORDING TO THE ENTRY PERIOD SCHEDULE DETAILED ABOVE.
The Promotion Parties, Internet server(s), Internet and cellular telephone access provider(s), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate text messaging or entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer or cell phone device relating to or resulting from participation in this sweepstakes; inability to access any text message or e-mail connection, theft, tampering, destruction, or unauthorized access to, or alteration of entries; Automatic Entries that are processed late or incorrectly or are incomplete or lost due to cellular device, computer or electronic malfunction or traffic congestion on the Internet or on any web site, and/or cellular telephone lines; printing or other errors; problems with transactions and any Mail-in Entries which are late, lost, incomplete, misdirected, stolen, undelivered, mutilated, illegible, postage-due or any combination thereof; or theft or destruction or corruption of entries. Proof of submitting a Mail-in Entry or an Automatic Entry via text messaging is not considered proof of delivery or receipt. Illegible, incomplete and entries in excess of the stated number above will be disqualified. All entries become property of Sponsor and will not be acknowledged or returned. False and/or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. The information obtained from the entry will be used by Modern Mobile Management and its affiliates unless otherwise noted by the entrant. False and/or deceptive entries or acts shall render entrants ineligible. By registering to enter the Sweepstakes, entrant affirms that they have read and accepted these Official Sweepstakes Rules. The laws of the State of California apply to and govern this Sweepstakes and any claims must be raised and resolved in the Federal or state courts located in Los Angeles County, California, United States.

All Weekly Random Drawings and the Grand Prize Random Drawing will be conducted by representatives of the Sponsor, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes. Each prize winner will be notified as follows: If winner selected had entered via the Text Messaging Entry method, he/she will be notified within three (3) days of the drawing, via text message notification to the cellular telephone number received at time of Sweepstakes Entry. Such winner will be required to respond to this text message notification, as directed, within two (2) days, providing first and last name, date of birth, daytime telephone number and a valid mailing address (no post office boxes accepted) or their prize may be forfeited and an alternate winner selected at Sponsor’s sole discretion. If winner selected had entered via the Mail-in Entry method he/she will be notified within three (3) days of the drawing, via telephone call and/or e-mail notification to the telephone number and/or e-mail address included in the Mail-in Entry. Such winner will be required to respond to this notification within two (2) days, or their prize may be forfeited and an alternate winner selected at Sponsor’s sole discretion.
Grand Prize winner will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability, an IRS W-9 form and where legal, a Publicity Release form within three (3) days of date of issuance. Grand Prize winner’s travel companion is required to be twenty-one (21) years of age or older at time of Grand Prize winner notification and will be required to complete, execute and return a Release of Liability and (where legal) Publicity Release within this same three (3) day deadline. A pre-paid overnight delivery air bill will be provided to facilitate return of required documents.
If a prize notification or prize is returned as undeliverable for any reason, the prize may (at Sponsor’s sole discretion) be awarded to an alternate winner in a subsequent random drawing. Prizes are not transferable, assignable, or redeemable for cash. No substitution for a prize by a winner will be allowed. Prize must be accepted as awarded. If necessary, due to unavailability of the prize or parts thereof for any reason, a prize of comparable value will be awarded at the sole discretion of the Sponsor.
All Federal, state and local tax liabilities are the responsibility of the winners. Winners may be required to complete state and federal tax reporting information as a condition of prize receipt. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor to use the winner’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation.
PRIZES: WEEKLY RANDOM DRAWING PRIZE (thirteen (13) Weekly Random Drawing prizes will be awarded as one (1) prize per Weekly Random Drawing): Each Weekly Random Drawing prize consists a Players Network DVD Series. The approximate retail value (“ARV”) of each Weekly Random Drawing prize is $105.
GRAND PRIZE: (one (1) Grand Prize Random Drawing prize will be awarded): The Grand Prize consists of a trip for two (2) to Las Vegas, NV (“Las Vegas”). The Grand Prize includes: (i) round trip (“R/T”) economy class (coach) air transportation from the major U.S. gateway city airport closest to the winner’s hometown to Las Vegas, (ii) two (2) consecutive nights hotel accommodations (one [1] standard room, double occupancy) at a hotel selected by Sponsor, (iii) dinner at a restaurant selected by Sponsor ($250 maximum), and (iv) admission to a nightclub selected by Sponsor. The ARV of this prize is $3,000 (NOTE: specific retail value depends on departure city and dates of travel). All expenses and taxes not specifically mentioned herein, including without limitation or limited to, the transportation between the Grand Prize winner’s home and the major U.S. gateway city airport closest to the winner’s hometown are the sole responsibility of the Grand Prize winner. Note: all additional meals, gratuities, excursions, incidentals and any other expenses not specified herein as being awarded are the sole responsibility of the Grand Prize winner. The Grand Prize winner must be able to travel on dates selected by Sponsor or prize may be forfeited and at Sponsor’s sole discretion awarded to an alternate. All travel is subject to blackout dates and availabilities for all elements of the prize travel. No extensions will be allowed. Air tickets are not valid for frequent flyer mileage. Travel and lodging are subject to availability and certain restrictions and black out dates apply. Confirmed-space reservations will depend on seat availability at the time of request. Grand Prize winner and his/her travel companion will be required to provide valid Federal or state government issued ID at time of travel as required. No changes will be made to travel details once any portion of travel arrangements has been made. Releasees are not responsible for cancellation of any element of Grand Prize or for changes in schedule of any element of the Grand Prize. All taxes/fees and expenses in conjunction with air tickets are the responsibility of the Grand Prize winner, including all necessary government documentation. Hotel accommodations consist of room and room tax charges only. Travel must originate from and end at the same airport. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Releasees accept no responsibility for changes in schedule of any element of Grand Prize travel.
Trip is non-transferable and may not be redeemed for cash. An unclaimed and/or unused travel package will remain the property of Sponsor.
The total ARV of all prizes to be awarded in this Sweepstakes is $4,365.
The odds of winning a prize in a specific random drawing in this Sweepstakes are determined by the total number of eligible entries received for the specific random drawing and are equal regardless of method of entry.
LIMITATIONS ON LIABILITY: Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees’ sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage.
GENERAL: By entering this Sweepstakes, entrants agree that Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases the Releasees from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death). Winner acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.
If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site, cellular telephone number or service associated therewith (or any portion(s) thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is cancelled, the Sponsor will conduct a series of random drawings to award the applicable prizes from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at www.playersnetwork.com/sweeps. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE, CELLULAR TELEPHONE NUMBER OR SERVICE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. If a dispute arises about who submitted an entry via text messaging, the entry will be deemed submitted by the authorized account holder of the cellular telephone number entered at the time of text messaging entry. The authorized account holder is deemed the natural person who is assigned to a cellular telephone number by a cellular telephone service provider. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the cellular telephone number associated with the winning entry and that all eligibility requirements are met.
If a dispute arises about who submitted an entry via text messaging, the entry will be deemed submitted by the authorized account holder of the cellular telephone number entered at the time of text messaging entry. The authorized account holder is deemed the natural person who is assigned to a cellular telephone number by a cellular telephone service provider. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the cellular telephone number associated with the winning entry and that all eligibility requirements are met.

How do I start playing the game?
To start playing the Vegas Fantasy Sweepstakes, simply text the keyword VEGAS to 25852. You will be sent a return message on your mobile device instructing you how to proceed.
How do I submit my choice for the correct answer?
You can play the trivia game by sending in your guess via SMS by text messaging the corresponding letter of the option you are guessing to the number 25852 from your mobile handset (For example: to vote for option B, send B.)
How do I get my next trivia question?
After you answer your first question, you will automatically receive another question. You may play each game up to 4 times per week.
How do I enter the sweepstakes?
You can enter the sweepstakes in two ways. You can play the trivia game via SMS on your mobile phone. Each time you submit an answer to a trivia question, you will receive one free entry into the sweepstakes contest. You may also enter by postcard by sending your name, address, city, state, zip code, age daytime telephone number, e-mail address (if applicable) and the drawing number (if entering the weekly drawing, as outlined in the official rules) to: Vegas Fantasy Sweepstakes, 814 South Westgate, Suite 105, Los Angeles CA 90049.
Will I be entered for both the weekly and the grand prize?
Yes, your entry will enter you for the weekly prize for the week in which you are playing, as well as for the grand prize.
How will I be billed for playing?
After you confirm that you want to play the game, you will receive a confirmation SMS to your handset that will advise you that your message has been received and notifying you that a charge of $0.99 cents for each play will appear on your next wireless bill. You will be asked to confirm that you are willing to accept the charges before the fee is applied to your phone bill.
Does it matter which carrier I use as my mobile service provider?
This service is available on AT&T, T-Mobile, Sprint, Nextel, Boost, AllTel, Virgin, and Cricket.
Will I be billed if my message does not make it to the program sponsor?
No. If you make an error in your entry and your message is not delivered to the application, you will receive an error message on your device (standard carrier rates may apply). If you receive this error message, please try to enter again
How many times can I play?
You can play each game up to 4 times per week. Each mobile guess that you send to the program will generate a $0.99 cent billable event on your next mobile phone bill.
How do I send in an SMS message from my phone?
Sending an SMS is easy and fun! Although all handsets are different (see your user manual for complete details), most phones will have a “send SMS” or “send text message” option under their messaging menu item. From here you need to send the desired answer code to the number 25852. The number 25852 is the address that you are sending this message to and will go in the text message where you would otherwise put the phone number of the recipient.
How do I subscribe to the mobile alert services?
You can enter via SMS only. In your initial response message, you will be invited to opt-in to mobile alerts from Players Network. You must reply with the word PLAYER and confirm with the word OK to opt-in successfully.
How many messages will I receive in return for playing?
When you play, you will receive one thank you message in response plus as many questions as you would like to answer, up to 4 per week. Each week thereafter you will be asked if you’d like to continue playing the game. If you opt-in to receive future alerts and promotions from Players Network, you could receive periodic updates. At any time, you may send the word STOP to 25852 to opt-out and ensure you receive no future messages from the service.
Will I be billed for my response or for the mobile alerts I receive?
You will receive a confirmation SMS to your handset that will advise you that your message has been received and notifying you regular text message rates apply as per your contract with your respective wireless network operator. There are no premium message fees assessed for opting into the alert service, or for receiving future alerts from Players Network.
How do I stop the service once I have opted in?
Just text the word STOP to 25852. We’ll cancel your subscription. You may also opt out by clicking here.
